3. Account Creation and Responsibilities

3.2 Client Responsibilities

You are responsible for maintaining the confidentiality of your account credentials (username, password, etc.) and for all activities that occur under your account. If you believe your account has been compromised, you must notify Bukutano Easy Hosting immediately.

3.3 Eligibility

By creating an account, you confirm that you are at least 18 years of age and legally capable of entering into contracts.

4. Pricing and Payments

4.1 Pricing

The pricing for our hosting services is outlined on our website and is subject to change at any time. Prices may vary depending on the type of hosting plan, services, and subscription duration selected by you.

4.2 Billing Cycle

Payment for services is due in advance of each billing cycle. Our standard billing cycles are monthly, quarterly, or annually, depending on your plan. All prices are in Tanzania Shillings unless otherwise specified.

4.3 Late Payments

If you fail to pay on time, we reserve the right to suspend or terminate your services, including the loss of data. In the event of non-payment, we may charge late fees or reactivation fees as outlined in your service agreement.

4.4 Refunds

  • 45-Day Money-Back Guarantee: Clients may request a refund within 45 days of the initial purchase for shared hosting services, provided that no violation of our Acceptable Use Policy has occurred.
  • Refunds will not be issued for:
    • Domain registration services (as they are non-refundable once processed).
    • Renewal fees or services after the initial 30-day period.
    • Accounts terminated due to violations of our Terms and Conditions or Acceptable Use Policy.
    • Custom or additional services beyond standard hosting packages.

4.5 Taxes

Prices do not include applicable taxes, which may be added to your invoice according to your local tax laws.

5. Service Availability and Uptime Guarantee

We strive to provide 99.9% uptime for all services. However, this guarantee does not apply in cases of:

  • Scheduled maintenance (with prior notice to clients).
  • Events beyond our control (e.g., DDoS attacks, natural disasters, internet outages).
  • Client-related issues (e.g., actions that lead to service disruptions).

We are not responsible for any data loss, revenue loss, or damages resulting from downtime. Bukutano Easy Hosting may conduct regular maintenance or upgrades that may temporarily disrupt service, but we will make every effort to minimize this disruption.

6. Acceptable Use Policy (AUP)

By using Bukutano Easy Hosting’s services, you agree to comply with our Acceptable Use Policy. You agree not to engage in any prohibited activities outlined in the AUP, including, but not limited to:

  • Illegal activities such as fraud or hosting illegal content.
  • Distribution of malware, viruses, or any form of malicious software.
  • Spamming or unsolicited emails.
  • Violating intellectual property rights.
  • Overconsumption of system resources, causing disruption to the performance of our infrastructure.

A breach of the AUP may result in the suspension or termination of your account without notice.

7. Security and Data Protection

7.1 Data Security

We are committed to maintaining the security of your data by implementing industry-standard encryption methods, firewalls, and access controls. However, you are responsible for securing your website and account by using strong passwords and following best practices for website security.

7.2 Data Backup

We perform regular backups of your website data, but we strongly recommend that you maintain your own independent backups. We cannot guarantee the availability of backups outside the regular backup schedule. In the event of data loss, we will make efforts to restore the data from available backups, but we are not liable for any lost data.

7.3 Privacy Policy

8. Suspension and Termination

8.1 Client-Initiated Termination

You may cancel your account at any time by contacting Bukutano Easy Hosting support. Cancellations are effective at the end of the current billing cycle, and you will not receive a refund for unused time unless you qualify for a refund under our Money-Back Guarantee.

8.2 Business-Initiated Termination

We may suspend or terminate your services if:

  • You violate any terms of this agreement, including the Acceptable Use Policy.
  • You fail to make timely payments.
  • Your website poses a risk to our infrastructure or other customers.
  • We are required by law to terminate your account.

In the event of termination, we will notify you by email. You are responsible for ensuring that your data is backed up before termination. We are not liable for any data loss due to termination.

9. Limitation of Liability

  • Bukutano Easy Hosting is not liable for any indirect, incidental, special, or consequential damages resulting from the use of our services, including, but not limited to, loss of data, loss of business, or downtime.
  • Our liability is limited to the total amount paid by you for the affected service during the 12-month period preceding the claim.
  • We do not guarantee that our services will be uninterrupted or error-free.

You agree to indemnify and hold Bukutano Easy Hosting, its affiliates, officers, employees, and agents harmless from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of:
